Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Declaration, declaring that the appointment of 4th respondent in the post of Assistant Editor by a Memo bearing NO.SA.15/300/1901 DATED 11th/ 13th MAY, 2009 in preference to the petitioner is against the statutory rules of the 1st respondent, arbitrary and void and thereby direct the 1st respondent to appoint the petitioner in that post with consequential seniority and monetary benefits subject to any condition.

This matter earlier came up for consideration before this Court on 23.07.2024 and also on 13.08.2024. On both the occasions, there was no representation for the petitioner. Hence, the matter was directed to be listed under the caption "For Dismissal".

2. Today, inspite of the matter being listed under the caption "For Dismissal", there is no representation for the petitioner. In the circumstances, this Court is left with no other option except to dismiss the Writ Petition for

non-prosecution.

Accordingly, the Writ Petition stands dismissed for non-prosecution. There shall be no order as to costs. Miscellaneous Petition, if any, shall stand closed.
