Tmt.Kalavathi, F/62 v. Priyanga

2019-02-18Honourable Mr Justice G.K. Ilanthiraiyan2 pages

Crl.O.P.No.11159 of 2018 G.K.ILANTHIRAIYAN, J.

Today, the matter is listed under the caption "for being mentioned". 2.The learned counsel for the petitioners submitted that as per order dated 18.02.2019, the husband of the respondent viz., Muthukumar has paid Rs.10,000/- towards interim maintenance for the month of March and April 2019 (Rs.5,000/- per month) on 04.04.2019 and also filed a memo to that effect. The learned counsel further submitted that the order copy was made ready on 10.04.2019 and hence there was a delay in paying the maintenance for the month of March 2019 and the delay is neither wilful nor wanton. 3.It is seen that though the petition is ordered on 18.02.2019, the certified copy of the order was made ready only on 10.04.2019. Therefore, it is clarified that there is no fault on the part of the petitioners in respect of payment of interim maintenance to the respondent by her husband. The learned Judicial Magistrate, Harur, shall take up the petition filed by the petitioners and proceed with the trial.
