[Order of the Court was made by N.KIRUBAKARAN, J.,] These Petitions have been filed to condone the delay of 415 days in filing the above Appeals.
2.It is stated in the respective affidavits filed in support of these Petitions that the Petitioners have no source of income and hence, they could not file copy application and the same was filed belatedly and it was made ready on 20.12.2019 and thereafter, these Appeals have been filed. Therefore, there is a delay of 415 days.
3.However, counter affidavit has been filed by the Second Respondent stating that with an ulterior motive of getting more compensation and interest, these Petitions have been filed.
4.It is seen that these Appeals are filed for enhancement of compensation. The Petitioners lost their parents in a tragic accident. Hence, there is a delay in filing copy application before the Tribunal as they do not have source of income 1/3
and the Appeals were also filed belatedly. Therefore, this Court is inclined to take a lenient view in condoning the delay in filing these Appeals. If a proper defence is available for the Respondents, it is always open for them to raise it in the Appeals. 5.Therefore, this Court is convinced with the reasons stated in the respective Affidavits filed in support of these Petitions to condone the delay of 415 days in filing the above Appeals and accordingly, these Petitions are ordered.
