This Civil Revision Petition is filed under Article 227 of the Constitution of India praying to set aside the fair and decreetal order dated 01.03.2011 passed in I.A.No.1349 of 2010 in O.S.No.268 of 2008 on the file of the Additional District Munsif Court, Alandur.

Mr.R.Rajaramani, learned counsel for the petitioner had filed a Memo dated 06.09.2018 before this Court stating that he had given a change of Vakalat to his client.

2. By an order dated 12.09.2018, this Court had directed the Registry to serve drafted notice to the petitioner returnable by 28.09.2018. Registry has also served notice to the sole petitioner and the same has been returned with an endorsement, "Died".

3. It is seen that though the deceased sole petitioner had received back the case bundle from his counsel long back, no steps have been taken by him to have himself represented in the Revision Petition.

4. In view of the fact that the revision petitioner has not evinced any interest in continuing with the revision after taking return of the brief and considering the fact that he is since deceased, this Court finds that no useful purpose would be served in keeping the revision pending. Therefore, this Civil Revision Petition is dismissed for non prosecution by this Court. No costs. Consequently, connected Miscellaneous Petition is closed.
