Criminal Original Petition filed under Section 582 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023, seeking to direct the II Additional NDPS Court, Chennai, to expedite the trial and to dispose the petition in Crl.M.P.No.5476 of 2025 in C.C.No.212 of 2021 within a stipulated period, as may be fixed by this Court.

This criminal original petition has been filed seeking to direct the II Additional NDPS Court, Chennai to expedite the trial and to dispose the discharge petition in Crl.M.P.No.5476 of 2025 in C.C.No.212 of 2021 as early as possible.

2. Heard the learned counsel on either side and perused the materials available on record.
3. The petitioner is an accused facing trial for the offences under Sections 8(c) r/w. 20(b)(ii)(B), 25 and 29(i) of the NDPS Act. A perusal of the records shows that he has filed a petition seeking discharge from prosecution in Crl.M.P.No.5476 of 2025 and the same is pending. Without disposal of the discharge petition, a direction cannot be issued to the trial court to expedite the trial.

In view of the above, the petitioner shall co-operate for the early disposal of the discharge petition and the learned trial Judge shall take every endeavour to dispose of the discharge petition in Crl.M.P.No.5476 of 2025 within a period of two (2) months from the next date of hearing and thereafter, take steps to conduct the trial and decide the case in C.C.No.212 of 2021 as expeditiously as possible.
5. With the above direction, this criminal original petition stands disposed of.
