Ma.Ve.Su .No.13/2002 quash the same and direct the respondents 1 & 2 to evaluate the B.Ed. degree dated 28.9.2002 issued by the Bharatiya Shiksha Parishad (U.P.) to the petitioner.

O R D E R

The order dated 16.4.2002 passed by the first respondent is sought to be quashed.

2. A direction is sought for to validate the B.Ed. Degree dated 28.9.2002 issued by Bharathiya Siksha Parishad. Grant of equivalence certificate of Degrees granted by various Universities across the country has to be done by a committee constituted for the purpose of recommending the equivalence with reference to the rules in force. The Committee concerned has to recommend for grant of equivalence considering the various factors. In the event of any such recommendation, the Government is competent to pass orders granting equivalence in respect of the Degrees granted by various universities across the State. When certain procedures are contemplated for the purpose of grant of equivalence of Degree granted by various universities, the present relief sought for by the petitioner to grant equivalence in B.Ed Degree obtained by him from Bharathiya Siksha Parishad at Uttar Pradesh cannot be considered at all.

3. If at all such an equivalence is to be granted, the petitioner has to approach the competent authorities for the purpose of placing the Degree before the committee for consideration. However, such expert exercise cannot be undertaken in a writ proceeding under Article 226 of the Constitution of India and therefore, the Writ Petition deserves no merit consideration and stands dismissed. No costs. Consequently, W.P.M.P.Nos.31433 and 31434 of 2005 are dismissed.
