JUDGMENT
The learned counsel appearing for the appellant submits that the matter has been settled out of court and hence, the petitioner may be permitted to withdraw the appeal. The learned counsel for the appellant further seeks permission of this Court to withdraw the deposit of Rs.25,000/-, which has been made at the time of filing the appeal.
2. In view of the submission made by the learned counsel for the petitioner that the matter has been settled out of court, the Civil Miscellaneous Appeal is dismissed as withdrawn. The appellant is permitted to withdraw the sum of Rs.25,000/-, which was deposited at the time of filing the appeal. No costs. Consequently, connected miscellaneous petition is closed.
