Prayer: Writ Petition filed under Article 226 of Constitution of India, praying for issuance of writ of mandamus directing the respondents to consider the representation of the petitioner dated 14.06.2012 in the light of the proceedings No/3497/A3/2010 dated 07.07.2011 of the respondent and consequently direct the respondent to revise the petitioner's promotion as Sub Registrar Grade I and grant all consequential and attendant benefits. O R D E R

This writ petition has been filed to consider the petitioner's representation dated 14.06.2012 and to revise the petitioner's promotion as Sub Registrar Grade I.

The learned counsel for the petitioner submitted that the petitioner joined the service in the year 1979 as a Section Writer and got promoted to the post of Junior Assistant in the year 1982 and subsequently as Assistant in the year 1994. Further, in the year 2010 the petitioner got promoted as Sub Registrar Grade I and on attaining the age of superannuation he retired from service on 30.04.2011. 3.

It is further submitted by the learned counsel for the petitioner that the petitioner was promoted to the post of Sub Registrar Grade II in the year 2001 and Sub Registrar Grade I in the year 2010. The Government has issued G.O.Ms.No.173 dated 13.10.2010 and according to which the respondents issued proceedings dated 07.07.2011 revising the seniority for the post of Sub Registrar Grade II with retrospective effect, wherein the Page No.2 of 4

petitioner's name was included in the seniority list for the year 1997-1998 itself. If so, the petitioner is entitled to be promoted to the post of Sub Registrar Grade I earlier to 2010.

It is also further submitted by the learned counsel for the petitioner that one Rani was directly recruited to the post of Sub Registrar Grade II in the year 2002 and subsequently promoted to the post of Sub Registrar Grade I in the year 2006-2007. Since the petitioner is senior to one Rani, he is entitled to antedated promotion much earlier that Rani. Hence, this writ petition.

The learned Additional Government Pleader submitted that if specific time frame is granted by this Court, the petitioner's representation dated 14.06.2012 would be considered.

Considering the submission made by the Additional Government Pleader, the respondents are directed to consider the petitioner's representation dated 14.06.2012 on merits, in accordance with law and pass appropriate orders within a period of six weeks from the date of receipt of a copy of this order.
