The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 4 of TNPPDL Act, in Crime No.30 of 2026 on the file of the respondent Police, seeks anticipatory bail.

The allegation against this petitioner is that the petitioner herein due to previous enemity set fire to the Bolero Car that belongs to the defacto complainant and caused damaged to worth about Rs.5 lakhs. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution; prior to this, the defacto complainant damaged the car of the petitioner was continuously demanding the defacto complainant to set right the same; further the defacto complainant has not come forward to rectify the same and made a false complaint against the petitioner and that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the car of the complainant is damaged of worth about five lakhs and that the investigation of this case is pending.

Considering the facts and circumstances of this case, gravity of offence, and taking note of the fact that the huge value damage was caused and that the investigation of the case is pending, this Court is not inclined to grant anticipatory bail to the petitioner.
