O R D E R
The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 329(4), 296(b), 76 and 351(3) of BNS Act, 2023 read with Section 3 of Tamil Nadu Prohibition of Harassment of Women Act, 1998 in Crime No.216 of 2025, on the file of the respondent Police, seeks anticipatory bail.
2. The allegation against the petitioner is that the petitioner was residing in the very same building of the defacto complainant's house. While the defacto complainant was sleeping inside her house along with his son, the petitioner herein sneak into the house and attempted to commit rape. Hence, the case.
3. This Court had earlier dismissed the petitioner's anticipatory bail on 18.09.2025 by stating the following reasons:
Considering the above facts and circumstances of the case, taking note of the submission made by the learned Government Advocate (Crl. Side) and since the allegation against the petitioner is that he sneak into the house of the defacto complainant and attempted to commit rape, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original 2/4
Petition is dismissed.
Now, without any change in circumstances, present petition is filed. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
