Respondents Prayer: Writ Petition filed under Article 226 of Constitution of India, praying for issuance of Writ of Certiorarifed Mandamus calling for an entire records in connection with the impugned notification of the 4th respondent, so far as it related to the calling for the appointment of retail outlet dealer

(S.315) in Koneripatti - Kakkaveri Road (which runs over a stretch of 3 K.Ms) in State Highway No.79, Rasipuram Taluk, Namakkal District, near the retail outlet of the petitioner, published in the Tamil Daily Dhinakaran issue on 23.10.2010 and quash the same and consequently forbear the respondents from appointing any new retail outlet dealers in the above said place.

ORDER

The petitioner has come up with this Writ Petition calling for the entire records in connection with the impugned notification of the 4th respondent, published in the Tamil Daily Dhinakaran issue on 23.10.2010 and quash the same and forbearing the respondents from appointing any new retail outlet dealers in the above said place.

2. Today, when the matter was taken up for consideration, the learned counsel for the petitioner, on instructions, submitted that the relief sought for herein has become infructuous and hence, nothing survives for adjudication in this writ petition.

3. In view of the above submission made by the learned counsel for the petitioner, this writ petition is dismissed as having become infructuous. No costs. Consequently the connected Miscellaneous Petitions are closed. s/d- Assistant Registrar True Copy Sub-Assistant Registrar msr To
