ORDER
The petitioner herein apprehends arrest at the hand of the respondent police for the offences punishable under Sections 4(1)(B), altered to Section 4(1)(aa) read with Section 24 of TNP Act, in Crime No.254 of 2025, on the file of the respondent police, seeks anticipatory bail.
2. The allegation against the petitioner is that 189 bottles of IMFL were recovered from A2 and A3, who were selling liquor. They were arrested and
later released on bail. The investigation revealed that the petitioner is the supplier of the liquor to A2 and A3 to sell the same during prohibited hours outside his Bar.
3. The learned counsel for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case. He further submitted that only based on the confession of the arrested co-accused, this petitioner has been implicated in this case and the petitioner is the owner of the bar and ready to abide by any stringent conditions. It is further submitted that arrested coaccused already been released on bail by the Trial Court vide order dated 11.08.2025 made in Crl.M.P.No.1088 of 2025. Hence, he prays for grant of anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and further submitted that the petitioner who is the owner of the bar has been arrayed as A1 in this case and the earlier anticipatory bail application filed by the petitioner was dismissed by this Court on 21.08.2025 and opposed for grant of anticipatory bail to the petitioner.
5. Considering the facts and circumstances and that the co-accused from whom the recovery was made were already released on bail, this Court is
inclined to grant anticipatory bail, subject to following conditions.

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance, within a period of fifteen (15) days from the date on which the order copy made ready, before the learned District Munsif cum Judicial Magistrate, Tiruporur, on condition that the petitioner shall execute a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that:
[a] the petitioner shall report before the learned District Munsif cum Judicial Magistrate, Tiruporur daily at 10.30 am., for a period three weeks and thereafter as and when required for interrogation. [b] the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer or tamper with the evidence;
[c] the petitioner shall not abscond either during investigation or trial. [d] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala
[(2005)AIR SCW 5560].
[e] If the accused thereafter abscond, a fresh FIR can be registered under Section 269 B.N.S.2023.
