Ramesh v. The Government Of Tamil Nadu

2019-02-12Honourable Mr Justice S.M. Subramaniam2 pages

W.P.No.3220 of 2019 S.M.SUBRAMANIAM, J It is brought to the notice of this Court by the learned counsel appearing for the writ petitioner stated that inadvertently, grade pay has been wrongly mentioned as Rs.4,400/- instead of Rs.4,200/-. Likewise, it is mistakenly typed as if the writ petitioner submitted a representation to the second respondent instead of first respondent.

2. Therefore, paragraph Nos.2 and 3 of the order dated 12.02.2019 in W.P.No.3220 of 2019 is corrected as follows:

2. The learned counsel for the writ petitioner states that as per G.O.Ms.No.306, Finance(CMPC) Department, dated 12.09.2018, the writ petitioner is entitled to get grade pay of Rs.4,200/- with effect from 10.01.2006. In this regard, the petitioner has submitted a representation to the 1st respondent on 13.11.2018 and the same is yet to be considered.

3. Thus, without going into the merits of the case, the 1st respondent is directed to consider the representation submitted by the writ petitioner on 13.11.2018 and pass orders on merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order and the writ petitioner is directed to enclose a copy of the representation with all relevant Government Orders, along with the order passed in the writ petition.

10.04.2019 ssb Note: Registry is directed to carry out the amendment and issue fresh order.
