PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order dated 30.01.2019 passed by the 2nd respondent and quash the same consequently direct the respondents to grant permission public meeting to conduct 102nd birth anniversary of former Chief Minister beloved late Dr.M.G.Ramachandran (M.G.R) on 03.02.2019 or on the date to be fixed.

ORDER
The petitioner has approached the second respondent on 09.01.2019, seeking permission to conduct a public meeting and to distribute welfare articles to the public on the occasion of birth anniversary of former Chief Minister late Dr.M.G.Ramachandran (M.G.R) near Quarry Office Bus Stop, Palagadu Road, Madukkarai, Coimbatore on 19.01.2019 between 6.00 pm., to 10.00 pm. To the shock and surprise, on 17.01.2019 he was served with the impugned order dated 17.01.2019 passed by the second respondent, rejecting the permission sought for by him to conduct the public meeting on the eve of the birth anniversary of former Chief Minister. Again, the petitioner submitted another representation dated 19.01.2019, to conduct the public meeting on the same venue on 27.01.2019. The said representation was also not considered and as such the
petitioner approached this Court by filing the writ petition in W.P.No.1983 of 2019.

When the matter came up for admission, the respondent police again rejected the permission on the ground that there is possibility of causing hindrance to public and traffic in that particular locality. Therefore, the Writ Petition in W.P.No.1983 of 2019 was disposed of by this Court to make a fresh representation specifying different venue within two days and directed the respondents to consider the same by an order dated 25.01.2019. Again, on 25.01.2019, the petitioner submitted another representation seeking permission to conduct the public meeting on 03.02.2019 near Marappalam Bus Stand, on the eve of birth anniversary of the former Chief Minister. However, the respondent did not consider the same and hence the petitioner filed this present petition.
3. The learned Government Advocate(Crl.side) submitted that now the date for conducting the meeting i.e., on 03.02.2019 expired and as such the present writ petition has become infructous.

Considering the above facts and circumstances, the petitioner is permitted to make a fresh representation in this regard to the second respondent forthwith, for the same venue namely near Marappalam Bus Stand. On such receipt, the second respondent is directed to consider the same after providing an opportunity to the parties and pass appropriate orders on merits and in accordance with law, within a period of two weeks thereafter.
5. With the above direction this Writ Petition is disposed of. Consequently, connected miscellaneous petition is also closed. No costs.
