The learned counsel appearing for the revision petitioner contended that this Civil Revision Petition has become infructuous, since, the appeal filed by the revision petitioner / first defendant on the file of the Subordinate Court, Uthagamandalam was allowed. He also made an endorsement to that effect.

2. In view of the endorsement made by the learned counsel appearing for the revision petitioner, this Civil Revision Petitions is dismissed as infructuous. No costs. Consequently, the connected Miscellaneous Petition is closed.
