PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, praying to direct the first respondent to transfer the investigation in Crime No.1688 of 2010 on the file of the Inspector of Police, J-7. Velacherry Police Station, Chennai, the second respondent to The Central Crime Branch, Chennai to secure the ends of justice.

ORDER

This petition has been filed seeking to transfer the investigation from the file of the second respondent.

2. A complaint was given by the petitioner on the ground that his father died due to electrocution and due to the gross negligence of the Electricity Department who had failed to maintain the electric wires properly and as a result of the same, had fell on the petitioner's father and he died.

3. It is seen from the records that an FIR has been registered under Section 174 of Cr.P.C. At this stage, no useful purpose will be served by transferring the investigation since even as per the complaint, no offence under Section 304-A is made out.

4. This Criminal Original Petition is disposed of by giving liberty to the petitioner to work out his remedy before the competent court and seek for compensation for the death of his father who died due to the negligence on the part of the Electricity Board for not maintaining the electric wire properly.
