PRAYER: The Second Appeal has been filed under Section 100 of C.P.C. against the Judgment and Decree of the learned Principal District Judge of Coimbatore dated 06.11.1997 made in A.S.No.122 of 1996 reversing the Judgment and Decree of the learned Principal District Munsif of Coimbatore dated 18.03.1996 in O.S.No.2585 of 1990.

The learned counsel for the appellant submits that the sole appellant has died. He has also made an endorsement to that effect in the bundle. However, the legal heirs of the appellant have not come forward to implead themselves in the appeal.
