ORDER
This Writ Petition (Criminal) has been filed challenging the impugned order dated Nil (served on 21.11.2025) passed by the 1st respondent and consequently, forbear the respondents from interfering with the petitioner's possession and enjoyment of 1203 sq.ft comprised in SF.No.654/1, T.S.No.16/47, Ward No.7 (Ward - E), Block No.17, situate at Nethaji Nagar, Madhanakuppam, Lakshmipuram, Korattur Village, Ambattur Taluk, Chennai - 600 099.

Heard the learned counsel for the petitioner and the learned Counsel for Government of Tamil Nadu (Crl. Side) appearing for the 1st respondent and the learned counsel for the 2nd respondent. Perused the materials available on record.

The petitioner owning the property to an extent of 1203 sq.ft, comprised in SF.No.654/1, T.S.No.16/47, Ward No.7 (Ward - E), Block No.17, situate at Nethaji Nagar, Madhanakuppam, Lakshmipuram, Korattur Village, Ambattur Taluk, Chennai - 600 099, by way of a registered Sale Deed dated 15.04.2024. The petitioner also assessed the subject property for property tax. While being so, the 2nd respondent herein also claiming a title over the subject property. Therefore, there was a dispute between the petitioner and the 2nd
respondent and the 2nd respondent herein lodged a complaint before the 1st respondent. Upon enquiry, the 1st respondent found that there is an identity issue in respect of the subject property. Therefore, the 1st respondent ordered to maintain status quo and not to put up anything in the subject property till the surveyor survey the land. Even thereafter, there was a dispute between the petitioner and the 2nd respondent and hence, the issue was referred before the Revenue Divisional Officer, Chennai Central Division.
4. The RDO conducted an enquiry and directed both the petitioner, as well as the 2nd respondent to approach the appropriate Civil Court for appropriate relief. Accordingly, the 2nd respondent filed a suit in O.S.No.295 of 2026 on the file of the Principal District Court, Tiruvallur, for declaration and permanent injunction in respect of the subject property. The 2nd respondent also prayed for mandatory injunction to remove the thatched shed put up by the petitioner. Therefore, the order passed by the 1st respondent is no more in force since subsequently, the RDO, Chennai Central Division, passed an order dated 25.05.2026, thereby directed the petitioner and the 2nd respondent to approach the Civil Court for appropriate relief. Therefore, it is also made clear that the petitioner and the 2nd respondent can approach the appropriate Civil Court for appropriate relief in respect of possession of the subject property.
