Crl.M.P.Nos.2295 & 2297 of 2024 in Crl.A.No.740 of 2023 Crl.M.P.Nos.2295 & 2297 of 2024 in Crl.A.No.740 of 2023 S.M.SUBRAMANIAM, J.
AND V.SIVAGNANAM, J.
Both the Criminal Miscellaneous Petitions have been filed to suspend the sentence of imprisonment, imposed on the petitioners by the learned IV Additional District and Sessions Judge of Bhavani in S.C.No.39 of 2022 dated 23.02.2023.
2. We have gone through the charges framed against the accused persons as well as the evidences of P.W.1 to P.W.4, who are eye witnesses. The deposition of the eye witnesses would be sufficient to form an opinion that the petitioners have not made out a primafacie case for considering the above suspension of sentence and accordingly, both the Criminal Miscellaneous Petitions are dismissed. List the Criminal Appeal for final hearing after one week. [S.M.S., J.] [V.S.G., J.] 19.10.2024 mrp https://www.mhc.tn.gov.in/judis
