ORDER

(Order of the Court was made by N.Sathish Kumar J.) This petition has been filed to condone the delay of 1459 days in representing the above Appeal Suit.

2. The learned counsel for the appellant submits that the appellant is on continuous treatment for brain epilepsy and he was advised not to travel for long distance. Hence, there is a delay in re-presenting the appeal.

3. Though the delay is inordinate, considering above submission and in order to give a fair opportunity to contest the case on merits, we are inclined to allow this petition.

4. Accordingly, this petition is allowed and the delay of 1459 in representing the appeal is condone.
