Peria Marakkal ... respondent PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India against the orders dated 01.07.2010 passed in I.A.No.63/2009 in I.A.No.202/2005 in CFR No.4568 of 2005 by the Subordinate Judge, Bhavani.
For Revision Petitioner : Mr.V.Ayyadurai For respondent : Mr.Zeeneth Begum
ORDER
This revision petition has been against the orders passed by the trial court in dismissing the petition in I.A.No.63/2009 in I.A.No.202/2005 in CFR No.4568 of 2005.
2. It is represented by the learned counsel appearing for the respondent that the sole respondent died in the year 2012. Though the respondent died in the year 2012, no steps have been taken to implead the legal heirs of the deceased, which clearly indicates that the petitioner has no interest in prosecuting the case. If really, he is having interest in prosecuting the case, he should be very vigilant and implead all the legal heirs of the deceased respondent. For the last 6 years, the petitioner has not taken any steps. Hence the revision petition is dismissed for non prosecution. No costs.
