..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the Respondents to include the name of the petitioner in the panel drawn for the year 2012-2013 for promotion to the post of Assistant at the appropriate place and to give promotion to the petitioner as Assistant on par with his juniors from the date on which his juniors were promoted to such post with all consequential service and monetary benefits.

ORDER

The petitioner was selected to the post of Junior Assistant and on such selection, he was allotted to the Civil Supplies and Consumer Protection Department.

2. It is the grievance of the petitioner that he was not sent for training along with the juniors and the same resulted in non consideration of his case for completion of probation and further promotion.

The petitioner having found that under similar circumstances, this Court passed an order dated 5 June 2013 in W.P.No.13852 of 2013 and the same was implemented by the second respondent vide proceedings dated 23 September 2013, submitted a representation on 11 February 2014. However the representation was not considered by the second respondent resulting in filing this writ petition.

3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing on behalf of the respondents.

4. The first respondent is directed to consider and dispose of the representation submitted by the petitioner dated 11 February, 2014 on merits and in accordance with law and more particularly in the light of the order dated 5 June 2013 in W.P.No.13852 of 2013 and the related order passed by the second respondent on 23 September 2013. Such exercise shall be completed as expeditiously as possible and in any case on or before 19 March 2015.

5. The writ petition is disposed of with the above direction. No costs.
