Prayer : Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Certiorari, calling for the records from the 3rd respondent vide Lr.No. 12793/2009-19, dated 27.01.2012 together with the order of the 4th respondent, dated 16.05.2012, bearing Ref.No. RM/12/000978, quash the same as illegal, violative of principles of natural justice, arbitrary and violative of Articles 21 and 300A of the Constitution of India. ORDER

This Writ Petition is filed challenging the order of the 3rd respondent dated 27.01.2012 and the order of the 4th respondent dated 16.05.2012, whereby the punishment of stoppage of increment for one year was imposed on the petitioner.

2.When this Writ Petition is taken up for hearing, the learned Standing Counsel appearing for the respondents 1, 2 and 4 submitted that in fact, the charge was that the petitioner along with others was deputed for election duty and that they have not properly maintained Form - 17A Register, for which a 2/5

communication was received from the respondents 3 and 5. Based on the communication of the 3rd respondent, the disciplinary proceedings were initiated against the petitioner and the punishment of stoppage of increment for one year without cumulative effect came to be imposed. However, the Bank has not given effect to the punishment on the petitioner, as the petitioner has already retired from service on 30.06.2021. Since the punishment of stoppage of increment was not given effect to till the date of his retirement, the relief sought for in this Writ Petition has become infructuous. Recording the submissions of the learned counsel for the respondents, this Writ Petition is dismissed as infructuous. Consequently, connected Miscellaneous Petitions are closed.
