242132436/ 2025 dated 10.12.2025 returned in Refusal No.FL/ Arcot/79/2025 dated 10.12.2025.

ORDER

Asserting that the petitioner inherited properties of her father D.Kannappa upon his death, the petitioner and the legal heirs executed partition deed dated 10.12.2025 and presented the same for registration before the second respondent. The request for registration was declined under the impugned refusal check slip by citing the pendency of a civil suit. Hence, this writ petition.

2. Learned counsel for the petitioner submits that no interim order restraining the registration of conveyances was issued in the civil suit.

3. Mr.S.Jayachandran, learned Government Advocate, accepts notice for both the respondents.

4. On perusal of the impugned refusal check slip, the only reason mentioned therein is the pendency of O.S.No.132 of 2024. There is no reference therein to any order restraining the registration of conveyances. In these circumstances, the impugned order cannot be sustained and is hereby set aside.

5. As a corollary, the petitioner is permitted to re-present the partition deed for registration within two weeks from the date of receipt of a copy of this order. Within two weeks therefrom, subject to fulfilment of other requirements relating to registration, the registering officer shall register the document unless an order restraining such registration were to be received in the meantime.

6. The writ petition stands disposed of on the above terms without any order as to costs.
