W.M.P.No.11959 of 2016 in W.P.No.28400 of 2014 T.S.SIVAGNANAM, J.

This petition has been filed at the instance of the 4th respondent to modify the order dated 15.3.2016 passed by this Court a direction of the order by permitting him to carry out demolition of the portions of the superstructures in question, taking all necessary precautions and adopting all safety measures under the supervision of the Fire Department Personnel and local police authorities.

2. In fact, such a submission was made even when the time when the writ petition was heard and this court was not inclined to accept the same and disposed of the writ petition by an order dated 15.3.2016 issuing certain directions.

3. Learned counsel appearing for the petitioner submitted that when the case was heard by this Court, he was not in possession of the notice issued by the CMDA under Sections 56 and 57 read with Section 85 of the Tamilnadu Town and Country Planning Act, 1971 and he has now filed these notices in the typed set of papers.

4. As rightly pointed out by the learned counsel for the respondent, these notices were issued during 2007 and 2010 calling for production of the approved plan and it is not known as to how these notices would in any manner render any assistance to the

msr case of the petitioner herein vis a vis the order in direction issued by this court.

5. In the light of the above, this court is not inclined to modify the order passed by this Court on 15.3.2016 . Accordingly, this petition is dismissed.
