(1) The learned counsel for the petitioner states that the respondent/defacto complainant had unfortunately expired. (2) In view of that particular fact, the present petition is closed.
(3) However, if a request is placed before the Trial Court, viz., the Judicial Magistrate No.2, Chengalpattu, where CC.No.316/2015 is pending, for substitution and if somebody else appears on behalf of the defacto complainant to prosecute the matter and if the learned Magistrate, takes such a request on file, then the petitioner herein is granted liberty to file a similar petition afresh before https://hcservices.ecourts.gov.in/hcservices/
this Court. Consequently, connected miscellaneous petition is closed.
