2. Mr.P.Baburaj, learned counsel representing the counsel on record for petitioner and Mr.R.Muniyapparaj, learned Additional Public Prosecutor who accepts notice for respondent are before us.

3. We perused the affidavit. In paragraph No.4 of the affidavit, difficulty for the appellant in mobilizing funds to file the appeal has been cited as the reason.

4. Considering the facts and circumstances of the case and nature of the matter, we are inclined to accede to COD prayer.

5. Captioned Crl MP ordered as prayed for i.e., Delay condoned. There shall be no order as to costs.
