PRAYER: This Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the 4th respondent to pay the State Advisory Price (SAP) to the petitioner members for the year 2014-2015 forthwith. O R D E R

The relief sought for in the present writ petition is to direct the 4th respondent to pay the State Advisory Price (SAP) to the petitioner members for the year 2014-2015 forthwith.

2. Paragraph No.11 of the counter affidavit filed by the 3rd respondent states that the Government has supported 4th respondent mills by sanctioning various financial assistance and also continuously supporting the mills indirectly by extending subsidy assisted agriculture related schemes such as Sustainable Sugarcane Initiative and drip irrigation etc., to improve the raw material availability and financial position of the farmers as well as mills. Further the SAP arrears which is advisory in nature over and above Fair and Remunerative Price (FRP) pertaining to 2014-15 season will be paid by the 4th respondent mills, whenever the financial position of the mills improved.

3. However, subsequent payments are also made and there are revision of pay thereafter. The writ petition was filed in the year 2016 and about 5 years lapsed. Under these circumstances, if any other grievances exists, the petitioner is at liberty to approach the competent authority for redressal.

4. With these observations, the writ petition stands disposed of. No Costs.
