ORDER

This petition has been filed to quash the proceedings in C.C.No.3861 of 2010 on the file of the learned II Metropolitan Magistrate, Egmore, Chennai, thereby taken cognizance for the offences under Sections 41(d) and 102 of Cr.P.C., and altered into Section 14(3) read with 25(2) of Antiquities and Art Treasure Act 1972 and Section 65 of MCP Act as against this petitioner.

2. The learned counsel for the petitioner seeks permission of this court to withdraw this Criminal Original Petition. https://hcservices.ecourts.gov.in/hcservices/

3. The learned Additional Public Prosecutor submitted that C.C.No.3861 of 2010 from the file of the learned II Metropolitan Magistrate, Egmore, Chennai was transferred to the learned Chief Judicial Magistrate, Kumbakonam in C.C.No.44 of 2018. However, he would further submit that the trial has been already commenced and the prosecution case is posted for the Office of the Investigation Officer.

4. Therefore, the trial Court viz., the Additional Chief Judicial Magistrate, Kumbakonam to complete the trial within a period of three months from the date of receipt of a copy of this order. The petitioner is at liberty to raise all the grounds before the trial Court.

5. In view of the above, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is also closed.
