The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406 and 420 IPC, in Crime No.621 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is the wife of the accused/Haja Mohideen, who started a Finance investment firm through which he collected money from the depositors to invest in the stock market and higher return benefits from it. Thereafter, the petitioner's husband not returned the money and cheated them. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated in this case. He further submitted that the petitioner is not a part of the above case. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner along with her husband have collected money from the depositors and cheated them. He further submitted that very recently this Court dismissed the anticipatory bail in Crl.O.P.No.463 of 2023 dated 12.01.2023 and there is no change of circumstances.

Taking into consideration the facts and circumstances of the case, also considering the fact that this Court very recently dismissed the earlier bail petition in Crl.O.P.No.463 of 2023 dated 12.01.2023 and there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
