PRAYER:

Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of declaration, declaring paragraph 1 & 2 of the appointment order issued by the second respondent herein in his proceedings R.No.8580/E5/A3/04 dated 24.08.2005, restricting the joining time in respect of the appointment issued to the petitioner after a lapse of 21 months from the date of selection without permitting the petitioner to complete his Post Graduate in M.S.General Surgeory currently undergone by the petitioner commenced in May, 2004 and ending in February 2007, as illegal and violative of Article 14, 16 and 19 of the Constitution of India and consequently directing the second respondent herein to permit the petitioner to extend the time for joining as Assistant Surgeon in the service of the second respondent department.
