ORDER

The Revision Petitioner herein is the plaintiff filed the suit in O.S.No.159 of 2022 on the file of District Court, Tiruppur for the relief of partition and separate possession against the defendants 1 and 2.

2. Since the relief claimed by the Revision Petitioner is only seeking a direction for a speedy disposal, the notice to the respondent is dispensed with.

3. The learned counsel for Revision Petitioner would submit that he filed a suit for the relief of partition, but inspite of earlier direction given in C.R.P.No.3454 of 2023, the respondent is not cooperating for the trial proceedings. In the meanwhile, her mother died as she suffered with cancer. All these years, she was standing before this court and the respondent is dragging the case and not intended to solve the dispute. Hence, she seeks a direction to trial court to dispose the suit within a time frame as fixed by this court.

4. Considering the facts and circumstances and the fact that the 1st defendant also died during the pendency of proceedings and the dispute is pending between sisters and the fact that the suit was filed seeking the relief of partition, this Court is inclined to direct the trial judge to commence the trial and dispose the case as expeditiously as possible within a period of three months from the date of receipt of copy of this order. Accordingly, this Civil Revision Petition is disposed of. No costs.
