2. With reference to the prayer, the learned counsel appearing on behalf of the respondents would submit that the the students had already exhausted their maximum period for completion of B-Ed course. Therefore they are not eligible to appear for supplementary examinations. The details regarding the eligibility are stated in paragraph nos. 3 and 5 of the counter affidavit, which reads as under:
"I state that the list of students enumerated in the prayer were admitted in B.Ed (2 years course) belonging to the different academic years ranging from 2012 to 2018. It is pertinent to point out that as per the B.Ed., Regulations and Academic Resolution it is very clear that "the B.Ed Degree Programme should be completed by the students teachers in not more than 4 years from the date of admission to the programme"
As per the above Regulation the Student enumerated in SL.No: 12 viz., Adam belonging to 2018 Academic year, hence he alone is eligible to take up the forthcoming supplementary examinations. The following table will clearly show how the other students are not eligible to take up the supplementary examinations: 3/7
Sl.
No.
Name of the student Academic year Governed by Regulations of Maximum period of completion of courses 3/4 years Latha 2010-2011 (2012 to 2015) Aruldoss 2010-2011 (2013 to 2016) Rejendran 2010-2011 (2014 to 2017) Kathiravan 2010-2011 (2014 to 2017) Sumathi 2010-2011 (2014 to 2017) Hariat Starina 2010-2011 (2014 to 2017) Baby 2015-2016 (2015 to 2019) Ricko Anandh 2015-2016 (2016 to 2020) Saravanan 2015-2016 (2017 to 2021) Ambiga 2015-2016 (2017 to 2021) Meena 2015-2016 (2017 to 2021) Adam 2015-2016 (2018 to 2022) The above date and the academic year will clearly prove that each student except Shri. Adam have exhausted their maximum period for completion of B.Ed Course. The only one student viz., Adam alone is eligible to write the supplementary examination since his completion of academic year falls in 2021-2022 and other students are not eligible as per the B.Ed., Regulations and the Academic Council Resolution dt. 12.09.2007.
...
5. I state that as per the Regulations 2015-16 and the Academic Resolution dated 12.09.2007, the 4/7
maximum period for completion of B.Ed Course is 4 years in respect of the students admitted from the Academic Year 2015-2016 onwards and 3 years in respect of students admitted prior to 2015-2016 (Since the course period was one year at that time). Hence the students enumerated in Sl.No: 1 to 11 are not eligible to take up the Supplementary Examinations and student in Sl.No:12 will alone eligible to take up the Supplementary examinations.
3. In view of the fact that the students are found not eligible to appear for the supplementary examinations and they have exhausted the period, the relief as such sought for cannot be granted.
4. Accordingly, the writ petition stands dismissed. No costs. 04.04.2024 Index : Yes Speaking Order (sha) 5/7
