This writ petition has been filed seeking issuance of a writ of mandamus directing the official respondents to consider the representation made by the petitioner on 02.12.2024 and to issue patta in favour of the petitioner with respect to the subject property.
2. Heard Mr.R.K.Gandhi, learned counsel for the petitioner and Mr.P.Sathish, learned Additional Government Pleader appearing for respondents.
3. The case of the petitioner is that he along with his family is in possession and enjoyment of the subject property for more than 25 years. The land belongs to the Government and according to the petitioner, several residents were residing in that area and were paying the land tax and other statutory payments and they were also issued patta. The petitioner, accordingly, submitted several representations seeking for issuance of patta with respect to the subject property. On receipt of the representation, a recommendation was also made by the Block Development Officer through communication dated 15.06.2009 to the District Collector to consider issuance of patta. The same did not evoke 2/4
any response and hence, the present writ petition has been filed before this Court.
4. In the considered view of this Court, the land in question stands in the name of the Government and therefore, there is no question of the third respondent issuing patta in this case. If at all any patta is issued, it will only be considered by the District Collector. In view of the same, there shall be a direction to the first respondent to deal with the representation made by the petitioner on 02.12.2024 on its own merits and in accordance with law and necessary orders shall be passed within a period of eight (8) weeks from the date of receipt of a copy of this order. This writ petition is disposed of with the above direction. No costs.
