On earlier occasion i.e., 11.03.2024, at request of the Learned Counsel for the appellant the matter was adjourned as last chance for taking steps, despite noticing that for the past two years steps have not been taken to bring on record the legal representatives of the deceased sole respondent. Today also the Learned Counsel for the appellant seeks further time and admittedly they are yet to get instructions from the parties. Hence, the Second Appeal is dismissed as abated. It shall be open to the Learned Counsel for the appellant to file appropriate application seeking to set aside the abatement as and when they get necessary particulars.
