Criminal Original Petition under Section 482 of the Criminal Procedure Code against the impugned order in Crl.R.P.No.19 of 2020 dated 11.04.2022 passed by the Principal Sessions Judge at Villupuram and confirm the order passed in C.M.P.No.586 of 2019 in M.C.No.1 of 2019 passed on 05.08.2020 on the file of learned Judicial Magistrate Court at Vanoor passed maintenance of Rs.2000/- to the 1st respondent and a sum of Rs.2,000/- to the 2nd respondent totally Rs.4000/-. ORDER

This petition has been filed challenging the order passed by the Principal Sessions Judge, Villupuram, in Crl.R.P.No.19/2020 dated 11.04.2022.

2. Heard the submissions of learned counsel for the petitioner and carefully perused the materials available on record.

3. The respondents have filed a Maintenance case before the learned Judicial Magistrate, Vanur, and the same is pending in M.C.No.1/2019. Pending the maintenance case, the application for interim maintenance was filed before the Trial Court. The Trial Court, after considering the facts and circumstances of the case and also the financial wherewithal, fixed interim maintenance at Rs.2,000/- for each of the respondents. Aggrieved by the same, a revision was filed before the Court below. The Court, below by order dated 11.04.2022, confirmed the order passed by the Trial Court.

4. In the considered view of this Court, the orders passed by both the Courts below does not suffer any illegality or perversity and does not require the interference of this Court.

5. Accordingly, this Criminal Original Petition is dismissed. Consequently connected miscellaneous petition is also closed. 11.01.2024 Index : Yes/No Speaking Order : Yes/No 2/3
