By consent, the Writ Petition is taken up and disposed of at the admission stage itself.
2. The present writ petition has been filed to direct respondents to dispose of the Second Appeal dated 12.11.2024 with the State Chief Information Commissioner under Sections 19(1) and 19(2) of the Right to Information Act as expeditiously as possible and to prove the petitioner with all the information requested to third respondent .
3. It is the case of the petitioner that she is the owner of 24.5 cents Page No.2 of 6
of land in S.No.62/9C, Koothanallur Taluk, Tiruvarur District acquired through a registered Sale Deed in 1990. She filed an RTI application on 09.09.2024 with the Tahsildar's Office seeking essential property documents, including UDR maps and revenue records, to address encroachment issues and verify boundary details. Despite the statutory period, no information was provided to the petitioner. Pursuant to the same, the petitioner filed First Appeal on 10.10.2024 requesting intervention and penalties for non-compliance . On receipt of the same, the second respondent sent reply dated 14.10.2024 to the petitioner requesting intervention and penalties for non-compliance. Aggrieved by the same, the petitioner filed second appeal before the first respondent, State Chief Information Commissioner on 12.11.2024 seeking penalties for the delay and disciplinary action against the responsible officers. However, the petitioner did not receive any information or update regarding the status of the second appeal. Hence, the petitioner has come forward with the present writ petition.
4. The learned counsel appearing for the petitioner submitted that Page No.3 of 6
he has filed the second appeal dated 12.11.2024 before the first respondent.
5. The leaned Standing Counsel appearing for the fist respondent submitted that the second appeal filed by the petitioner dated 12.11.2024 and the same will be disposed of on merits and in accordance with law within a time frame that may be fixed by this Court.
6. Heard the learned counsel appearing on either side and also perused the materials available on records.
7. In view of the above submissions made by the learned counsel on either side, The first respondent is directed to dispose the second appeal filed by the petitioner dated 12.11.2024 on merits, in accordance with law, and pass appropriate orders, within a period of three months from the date of receipt of a copy of this order.
