The suit has been filed for infringement of design and passing off.

2. The plaintiff is having its place of business at Chennai, which is within the jurisdiction of this Court. According to the plaintiff, the defendant is passing off their products as that of the plaintiff's by using a similar design. However, the defendant is having its office at Bengaluru. Under those circumstances, this application has been filed seeking leave to sue. Since substantial part of cause of action has arisen within the jurisdiction of this Court, this Court is inclined to grant leave to sue as prayed for. Accordingly, this application is allowed as prayed for.
