PRAYER:- Writ petition filed under Article 226 of the Constitution of India prays to issue a Writ of Certiorarified Mandamus to call for the records of the proceedings of the letter dated 30.12.2019 and to quash the same as illegal and without jurisdiction and to direct the 1st respondent to permit the petitioner to enter into a private treaty with the 2nd respondent under Rule 8(5) for sale of the properties at Plot Nos.81 and 82-B, Om Sakthi Nagar, Saravanampatti, Coimbatore and for consequential orders.

[Order of the Court was made by M.SATHYANARAYANAN,J.,] The learned counsel appearing for the petitioner on instructions seeks permission of this Court to withdraw the Writ petition with a liberty to work out his remedy in the pending SARFAESI Appeal before the Debts Recovery Tribunal, Coimbatore and he has also made an endorsement to that effect.

2. This Court heard the submission of Mr.Chandrasekaran, learned Standing Counsel appearing for the 1st respondent.

3. In the light of the endorsement made, this Writ Petition is dismissed as withdrawn and the liberty sought for by the petitioner is granted. No costs. Consequently connected miscellaneous petitions are closed.
