ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 120(b), 420, 458, 68 294(b) and 506(i) of IPC in Crime No.22 of 2016, seeks anticipatory bail.

2. This is the second anticipatory bail petition and the first anticipatory bail petition in Crl.O.P.No.25255 of 2017 was dismissed by this Court on 04.09.2017.

3. The petitioner's wife, being a Panchayat President, issued a bogus planning permission to the defacto complainant for constructing house in a park area and when the defacto complainant approached the authority for putting up a road, he came to know that his house has been located in a park area.

4. The learned counsel for the petitioner submitted that the layout was approved in the year 1991, and at that time neither petitioner nor his wife were in the helm of affairs.

5. Be that as it may, the planning permission for constructing the house in a park area was issued by the wife of the petitioner. This petitioner was also involved in real estate business.

6. In such view of the matter there is no change in fact situation for granting the relief of anticipatory bail.

7. In the result, the petition is devoid of merits and the same stand dismissed.

Accordingly, this Criminal Original Petition is dismissed.
