ORDER

The Criminal Original Petition has been filed to direct the learned Judicial Magistrate No.II, Tindivanam to dispose the Crl.M.P.No.3845/2019 in C.P.No.483/2019 in Crime No.413 of 2019 at early.

2. The learned counsel for the petitioner has submitted that the respondent has registered an FIR in Cr.No.413 of 2019 against one Doss, Son of Cheniaiyan under Section 392 of IPC based on the complaint lodged by one Prabhu. He further submitted that during the investigation, the first respondent has seized the petitioner's Car bearing Registration No.TN 29 BS 3956 and produced before the Judicial Magistrate No.II, Tindivanam and the same was remanded in C.P.No.483 of 2019. He further submitted that the petitioner has filed a petition under Section 457 of Cr.P.C., in Crl.M.P.No.3845 of 2019 seeking interim custody of the said Car and in the said petition, the learned Judicial Magistrate No.II, Tindivanam, after hearing both sides posted the matter "for orders" on 07.01.2020, but till date the order has not been passed and therefore, he prayed to direct the concerned Magistrate to dispose of the said petition at the earliest. https://hcservices.ecourts.gov.in/hcservices/

3. Per contra, the learned Additional Public Prosecutor requested to pass suitable orders in this matter.

4. Considering the aforesaid submissions of the learned counsel for the petitioner, the Judicial Magistrate No.II, Tindivanam, is directed to dispose of Crl.M.P.No.3845 of 2019 within a week from the date of receipt of a copy of the order.

5. With the aforesaid directions, this Criminal Original Petition is disposed of.
