ORDER
The review application has been filed to review the Oder of this Court in paragraph 5 of the Writ Petition in W.P.No.22803 of 2023 dated 02.08.2023.
2. The review has been sought mainly on the ground that there was a positive direction captured in paragraph 5 of the Writ Petition in W.P.No.22803 of 2023 dated 02.08.2023. According to the review petitioner, he has not been heard in the Writ Petition and no notice has been served to him.
3. The Writ Petition has been originally filed seeking a direction to the respondents to consider the representation of the petitioner and pass Order in terms of the G.O.Ms.Nos.338, dated 26.08.2010, 325, dated 22.07.2013 and 91 dated 22.04.2019. As the petitioner has already approached this Court in W.P.No.25907 of 2022, this Court directed the respondent, viz., the review petitioner to place the matter before the finance committee and syndicate for passing resolution in the light of the Government Orders referred above. However, while disposing the Writ Petition, in paragraph 5, this Court has captured some positive direction that if the Government Order stipulates change of designation, the same shall be implemented and denying such right merely on the gound that finance committee and the syndicate has not approved cannot be
countenanced and it is for the finance committe and syndicate to take a decision and pass final Order. It has been further held that merely because the proceedings has not be finally decided by either finance committee or syndicate, it cannot be said that the petitioner is not at all entitled to such relief.
4. This Court has passed the above Order at the admission stage itself on the basis of the instructions of the respondents, particularly, the Additional Government Pleader and on behalf of the University none appeared.
5. In such view of the matter, since it appears that matter had already referred to the finance committee and syndicate on 27.02.2024 and the same has been deferred, the respondents are directed to consider the representation of the petitioner afresh by placing matter before the finance committee and syndicate for passing resolution in the light of the above referred Government Orders on its own mertis within a period of three months from the date of receipt of a copy of this Order.
