The relief sought by the petitioner in this writ petition is to call for the records pertaining to the orders passed in G.O.Ms.No.138, Industries Department dated 27.09.2010 on the file of the first respondent and quash in so far as clause No.9 relating to medical allowance and direct the respondents to make payment of medical allowance by granting one month's salary every year on prorate basis every month as a part of salary with arrears from 27.09.2010 to petitioner forthwith.

2. Today, when the matter was taken up for hearing, learned counsel for the petitioner submitted that the matter has become infructuous and Page No.2 of 5

nothing survives in this writ petition for further adjudication. He also made an endorsement to that effect in the case bundle.

3. In view of the above submission coupled with an endorsement made by the learned counsel for the petitioner, this Writ Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is also closed.
