ORDER

The petitioner, who was arrested and remanded to judicial custody on 20.08.2025, based on execution of NBW issued against him in Spl.Sc No.49/2018 on the file of the Court of Sessions, Magalir Needhi Mandram (Fast Track Mahila Court,Tiruppur for the offences punishable under Sections 5(1) r/w 6 of POCSO Act, 2012 and u/s 363 of IPC in Crime No.507 of 2017, registered on the file of the respondent police, seeks bail. 2.The petitioner is facing trial in Spl.Sc No.49/2018 on the file of the Court of Sessions, Magalir Needhi Mandram (Fast Track Mahila Court,Tiruppur. He has not appeared for the hearing from 29.05.2024 till 20.08.2025. Hence NBW was issued against him and he was arrested on 20.08.2025.

3.The learned counsel appearing for the petitioner submitted that due to ill health and the counsel who appeared before the Lower Court has not informed the stage of the case to the petitioner, the petitioner was not able to appear on the date of hearing. Hence due to his non-appearance before the Trial Court NBW was issued as against him. He further submitted that the petitioner is ready to co-operate with the investigation and ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the prosecution case and submitted that it is a case of jumped bail for more than 3 years. Hence, he opposed to grant bail to the petitioner.

5. I have gone through the order passed by the Trial Court which reveals that the petitioner is absconding during the trial and for examination of witness and thereafter he has not come forward to appear before the Trial Court for more than 3 years.

5. Considering the facts of the case and the case is pending is from 2017, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition stands dismissed. However, this Court directs the learned Judge, Court of Sessions, Magalir Needhi Mandram (Fast Track Mahila Court,Tiruppur to speed up the Trial and if necessary split up the case and dispose of the same as early as possible.
