M/S A.P.SATHYA MURTHY Advocate PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehends arrest at the hands of the respondent police for the alleged offences under section 406, 420, 506(i) of I.P.C, in Crime No.25 of 2022 seeks anticipatory bail.

2. Heard the learned Counsel appearing for the petitioners and the learned Counsel appearing for the Intervener/defacto complainant.

3. It is a case admittedly where the defacto complainant has given Rs.20 lakhs to the petitioners herein to secure Government job and now by filing another complaint to recover that money.

4. This Court is of the view that giving money and securing Government Job itself is a criminal act.

5. The respondent police ought to have booked the defacto complainant also in this case.

6. While dismissing the anticipatory bail petition, this Court directs the respondent police to investigate the case properly and array the defacto complainant also as an accused and take proper action and complete the investigation within a period of 60 days from today(28.02.2022).
