I do not find any probable reason to fix a date for hearing, since even the counter affidavit has not been filed.

2. Learned counsel for the respondent states that for filing counter two weeks time should be granted.

3. After counter is filed, I am confident that if the matter is mentioned it would be heard if arguments are advanced.

4. Petition stands dismissed.
