WMP.No.3524 of 2020 in WP.No.32658 of 2019 M. DHANDAPANI, J This miscellaneous petition is listed today under the caption "For Clarification" at the instance of the learned counsel for the petitioner.
2.It is brought to the notice of this Court by Mr.Sankaran, learned counsel appearing for the petitioner that though the petition was filed challenging the order of the 3rd respondent with a further direction to consider the representation dated 05.01.19, submitted by the petitioner, however, inadvertently, in the para-5 of the order dated 21.11.2019, it has been wrongly mentioned as 3.6.19. It is further pointed out that though direction for grant of opportunity to the petitioner before passing order was ordered by this Court, however, the same has not been incorporated in the said order and, therefore, prays for necessary corrections and issuance of fresh order copy. 3.Though this Court, vide its order dated 21.11.19, had directed the respondents to consider the representation dated 5.1.19 submitted by the petitioner and to provide an opportunity to the petitioner before passing orders on the said representation, however the 1/4
same has been inadvertently omitted to be typed. In such circumstances, para-4 to 7 of the order shall stand substituted the following :- "4) Learned counsel appearing for the petitioner submits that without going into the merits of the matter, it would suffice if this Court permit the petitioner to file his objections before the 2nd respondent against the impugned order passed by the 3rd respondent and if any objection is filed this Court may issue direction to the 2nd respondent to pass appropriate orders in accordance with law.
5) Learned Government Advocate appearing for the respondents submit that if objection is filed by the petitioner before the 2nd respondent, the same would be considered and orders will be passed on the same in accordance with law.
6) Considering the request was made by the learned counsel for the petitioner, this Court permits the petitioner to file his objections before the 2nd respondent against the impugned order passed by the 3rd respondent. If any such objection is filed by 2/4
the petitioner, the second respondent shall consider the same and pass appropriate orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.
7) The writ petition is disposed of in the above terms. No costs. Consequently, connected miscellaneous petitions are closed."
4. Except the above modification in para Nos.4,5,6 & 7 of the order dated 21.11.2019, in W.P.No.32658 of 2019 and WMP.Nos.33063 & 33064 of 2019, shall remain unaltered. Accordingly, this miscellaneous petition is clarified.
5.Registry is directed to carry out the necessary corrections, as noted above and issue fresh copy of the order to the parties. 11.02.2020 jrs 3/4
