Respondents Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Certiorarified Mandamus calling for the records of the Hon'ble Debts Recovery Appellate Tribunal, the 4th respondent, in its order dated 5th December, 2002 passed in Misc Appeal No.422 of 2002 and quash the same and

consequently direct the 2nd respondent to release the retention money lying with him and payable to the petitioner and permit the petitioner to distribute the dividends to the eligible shareholders of the petitioner company for the financial year ended 31st March 2002.

Heard Mr.Amrith Bhargav, learned counsel for the petitioner and Mr.V.V.Sivakumar, learned counsel for respondent No.3.

2. Learned counsel for the petitioner states that the matter is settled and he seeks leave of this Court to withdraw the writ petition. The learned counsel has also made an endorsement to the said effect.

3. In view of the above, the writ petition is dismissed as withdrawn. No costs. Consequently, W.P.M.P.Nos.34174 and 34175 of 2005 are closed.
