ORDER

The petitioner, who was arrested and remanded to judicial custody on 23.11.2025 for the alleged offence punishable under Sections 296(b), 103(1) of BNS, in Crime No.450 of 2025, on the file of the respondent police, seeks bail. 1/4

2.The allegation against the petitioner is that he is the husband of the deceased. It is alleged that suspecting the fidelity of the deceased, the petitioner subjected her to harassment, as a result of which the deceased left the matrimonial home and started residing at her parents' house. Subsequently, the petitioner came to the parents house and again there was a quarrel with the deceased and at that time, he stabbed the neck of the deceased by using knife, causing severe injuries and she died on the spot. Hence, the complaint. 3.The learned counsel appearing for the petitioner submitted that due to sudden provocation, the occurrence took place. He further submitted that the petitioner is ready to co-operate with the investigation. Hence, he prays for grant of bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has no previous case and that the investigation is still pending and if the petitioner is released on bail, there is a likelihood that the petitioner will hamper the investigation. Hence, he opposed for grant of bail to the petitioner.

5. On perusal of the FIR and other connected materials, it was revealed that the petitioner stabbed the deceased with knife and the deceased was went to her parent's house and stayed along with her and though he has not having any previous cases and considering the nature of the allegations and that the investigation is still pending, this Court is not inclined to grant bail to the 2/4

petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 03.02.2026 drl To
