No.10357/AA5/2022 and 173/AA5/2023 dated 17.07.2023 and quash the same and consequently direct the second respondent to cancel the above said two
documents vide Nos.5450 of 2011 & 5451 of 2011 dated 30.12.2011 within the stipulated period that may be fixed by this Court. For Petitioner :

ORDER
This writ petition has been filed challenging the impugned order dated 17.07.2023 passed by the second respondent rejecting the petitioner's request for cancellation of the documents carefully disclosed in the affidavit filed in support of this writ petition on the ground that the petitioner will have to approach the civil Court.
2. Mr.P.Harish, learned Government Advocate, accepts notice on behalf of respondents 1 to 3.
3. The law is now well settled that if a party is seeking for cancellation of registered documents, the said party will have to approach the civil Court.
4. Learned counsel for the petitioner would now submit, on instructions, that liberty may be granted to the petitioner to approach the civil
Court for cancellation of the documents, which are more fully disclosed in the affidavit filed in support of this writ petition. Learned counsel has also made an endorsement to that effect in the Court bundle.
5. Accordingly, this writ petition is disposed of by granting liberty to the petitioner to seek for cancellation of the document more fully disclosed in the affidavit filed in support of this writ petition before the Civil Court.
